Terms of Service

1. Definitions

In these Terms of Service:

• "Property Assistant", "we", "us", "our" refers to the operator of www.property-assistant.ai and app.property-assistant.ai.
• "Platform" means the Property Assistant website, web application, APIs and all related services.
• "You", "your", "User" means any individual or entity accessing or using the Platform.
• "Subscription" means a paid plan (Basic, Pro or Elite) granting access to paid features of the Platform.
• "Content" means any text, data, images, files or other material submitted to or generated by the Platform.
• "AI Features" means any functionality powered by large language models or other artificial intelligence technologies.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding contract.
• Your use of the Platform does not violate any applicable laws or regulations.
• If using the Platform on behalf of a company or organisation, you have authority to bind that entity to these Terms.

3. Your Account

3.1 Registration

To access most features of the Platform you must create an account. You agree to provide accurate, current and complete information during registration and to keep it updated.

3.2 Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at team@property-assistant.ai if you suspect any unauthorised access.

3.3 One account per person

Each Subscription is for a single user. You must not share your login credentials with others or allow multiple individuals to access the Platform using one account, unless expressly permitted under an Elite or business plan.

4. Subscriptions & Billing

4.1 Plans

We offer the following subscription plans: Basic (£35/month), Pro (£75/month), and Elite (£135/month). Annual billing options are available at a 20% discount. Full details are at our Pricing page.

4.2 Free trial

New users may be offered a 7-day free trial. No credit card is required to start a trial. At the end of the trial period your account will revert to a free tier (limited functionality) unless you add a payment method and subscribe.

4.3 Billing & renewal

Subscriptions are billed in advance on a monthly or annual basis. Payments are processed automatically on the renewal date. By subscribing you authorise us to charge your chosen payment method on each renewal date.

4.4 Price changes

We may change subscription prices at any time. We will give you at least 30 days' written notice before any price change affects your existing subscription. Continued use after the notice period constitutes acceptance of the new price.

4.5 Refunds

We do not offer refunds for partial subscription periods except where required by law (e.g. your statutory rights as a UK consumer). If you believe you are entitled to a refund, contact us at team@property-assistant.ai.

4.6 Cancellation

You may cancel your Subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You retain access to paid features until that date.

5. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable UK or international laws or regulations.
• Engage in fraudulent, deceptive or misleading activity.
• Infringe the intellectual property rights of Property Assistant or any third party.
• Upload or transmit viruses, malware or other harmful code.
• Attempt to gain unauthorised access to any part of the Platform or its underlying infrastructure.
• Scrape, crawl or extract data from the Platform using automated means without our prior written consent.
• Resell, sublicense or commercialise access to the Platform or its outputs without our express written permission.
• Use the Platform in a way that could damage, disable, overburden or impair it.
• Use AI Features to generate content that is illegal, discriminatory, defamatory or otherwise harmful.

We reserve the right to suspend or terminate your account if you breach these rules.

6. Our Services

6.1 Service availability

We aim to provide a reliable service but we do not guarantee 100% uptime. The Platform may be temporarily unavailable due to maintenance, updates or events outside our control. We will endeavour to provide advance notice of planned downtime where possible.

6.2 AI-generated content

Our Platform uses artificial intelligence to generate analysis, recommendations and estimates (including ROI calculations, yield estimates and maximum offer figures). These outputs are for informational and educational purposes only. They do not constitute financial, investment, legal or tax advice. You must not rely solely on AI-generated content when making property investment decisions.

6.3 Third-party data

The Platform may incorporate property data, comparables and market information from third-party providers. While we strive for accuracy, we cannot guarantee the completeness or currency of third-party data.

6.4 Changes to the Platform

We may add, modify or remove features at any time. We will notify users of significant changes that affect paid functionality.

7. Disclaimer & Limitation of Liability

7.1 No financial advice

Property Assistant is not authorised or regulated by the Financial Conduct Authority (FCA). Nothing on the Platform constitutes regulated financial advice. All content is provided for general information and educational purposes only.

7.2 "As is" basis

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

7.3 Limitation of liability

To the maximum extent permitted by applicable law, Property Assistant shall not be liable for any:

• Loss of profits, revenue, data or goodwill.
• Indirect, incidental, special, consequential or punitive damages.
• Investment losses or decisions made in reliance on Platform outputs.

Our total aggregate liability to you in connection with the Platform shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.

7.4 Consumer rights

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law. Your statutory rights as a UK consumer are not affected.

8. Intellectual Property

8.1 Our IP

All content, software, designs, trademarks, logos and technology on the Platform are owned by or licensed to Property Assistant. You may not copy, reproduce, modify, distribute or create derivative works without our express written permission.

8.2 Your content

You retain ownership of any data and content you input into the Platform (e.g. deal data, notes). By submitting content you grant us a limited, non-exclusive licence to process and store it solely for the purpose of providing the services to you.

8.3 AI outputs

Outputs generated by AI Features in response to your inputs may be used by you for your personal or business purposes, subject to these Terms. You may not resell or redistribute AI-generated outputs as a standalone product.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to our collection and use of your personal data as described in the Privacy Policy.

10. Termination

10.1 By you

You may close your account at any time by contacting us at team@property-assistant.ai or via your account settings. Closing your account cancels any active Subscription at the end of the current billing period.

10.2 By us

We may suspend or terminate your account immediately, with or without notice, if:

• You breach these Terms.
• We believe your use poses a security risk or legal liability.
• We are required to do so by law.
• We cease to operate the Platform (in which case we will provide reasonable notice).

10.3 Effect of termination

Upon termination, your right to use the Platform ceases immediately. We may delete your account data in accordance with our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including Sections 7, 8 and 11) will continue to apply.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer and applicable law permits you to bring proceedings in your local courts.

We will always try to resolve disputes informally first. If you have a complaint, please contact us at team@property-assistant.ai and we will endeavour to resolve it within 14 business days.
